Ask a simple question in Cave Creek Unified

We asked the district for a simple reply to the costs of interest on the outstanding but unused bonds. Here is the exchange so far. [We removed the district's employee name from the exchange]

Below please find the requested FOIA request. Be advised that per the Arizona's Ombudsman office, there is no requirement that requests use a specific form or that they be signed, in fact requests can be oral.



All we are interested in is the information in the original email (at the bottom of this message), since the distirct has seen fit not to publish or refute this information publicly we are asking for it to disseminate to the community.

Our suggestion is that you publish it under 'JUST THE FACTS' section of the district website the for the community to see, then there would be no need for our request.

We have no desire to play games and waste your time, the district's resources, and the taxpayer's dollars. If the district feels the need to pass this on to its lawyers, please let us know prior to that and we withdrawl our request as we do not want to waste district funds and efforts on this. We would rather see these funds go to a teacher than a lawyer.

Secs. 39-121 to 39-126, I write to request electronic media (word processing documents, spreadsheets, databases, but not emails) of all public records related to bonds issued by the district in 2006. We ask that all electronic metadata be retained and transmitted with these records. If your agency does not maintain these public records, please let me know who does and include the proper custodian’s name and address.

I would request your response as soon as possible.

If you choose to deny this request, please provide a written explanation for the denial including a reference to the specific statutory exemption(s) upon which you rely. Also, please provide all segregable portions of otherwise exempt material.

Please be advised that I am prepared to pursue whatever legal remedy necessary to obtain access to the requested records. I would note that willful violation of the open records law can result in the award of legal costs, including damages and reasonable attorney fees. See Ariz. Rev. Stat. Sec. 39-121.02.
